Terms and Conditions – Wiz Driving
By booking a course of driving lessons (“Course”), practical driving tests and/or theory tests through www.wizdriving.co.uk or any associated services provided by Wiz Driving (trading name of Wiz Driving School Limited), you agree to these Terms and Conditions. Please read and understand this document before purchase.
1. Definitions 1.1 “You” or “your” refers to the learner driver and/or the purchaser booking a Course of driving lessons (“Lessons”) and/or any practical driving and/or theory tests through Wiz Driving. 1.2 “Wiz Driving”, “we”, “us” and “our” refers to Wiz Driving, the trading name of Wiz Driving School Limited, a company registered in England and Wales under company number 15508938. 1.3 “Instructor” refers to the self-employed Approved Driving Instructor (ADI) allocated to provide your Lessons. 1.4 “Suitable Instructor” means a fully qualified DVSA-approved driving instructor who meets our standards.
2. Our Service 2.1 Wiz Driving acts as an agent connecting you with independent, self-employed Instructors and assisting with booking practical and theory tests where included in your Course. 2.2 The contract for Lessons is solely between you and the Instructor. Wiz Driving is not a party to this contract and accepts no liability for the Instructor’s performance, behaviour, or any issues arising from Lessons, except where we are at fault. 2.3 We guarantee that any Instructor allocated will be a Suitable Instructor.
3. Booking Your Course 3.1 When booking, you enter into a contract with Wiz Driving for our administrative services (including Instructor allocation and test booking assistance where applicable) and act as agent for payments to the Instructor and DVSA. 3.2 It is your responsibility to:
- Agree timing, start location, and any changes directly with your Instructor.
- Raise any concerns about the Instructor’s behaviour or performance directly with them first, then log via our portal and contact us if needed. 3.3 We will endeavour to match your preferences (e.g., Instructor gender, vehicle type, availability) stated at booking, but cannot guarantee this. 3.4 Once an Instructor is allocated, reducing Course hours is not possible as we purchase a fixed block of Lessons on your behalf.
4. Lessons 4.1 You must hold a valid UK provisional driving licence and present it to the Instructor at the first Lesson and all subsequent Lessons/Tests. Failure may result in cancellation without refund. 4.2 Be punctual; Lessons will not be extended for late arrival. 4.3 The Instructor may refuse or cancel a Lesson if you:
- Use abusive/threatening behaviour.
- Are under the influence of alcohol/drugs.
- Wear inappropriate footwear or fail reasonable requests. We accept no responsibility for cancellations due to your non-compliance. 4.4 You must maintain reasonable availability (minimum 25 hours/week for intensive Courses) to complete your Course in the advertised timeframe.
5. Changing or Cancelling Lessons 5.1 Cancellation/rearrangement policy is set by your Instructor; standard requires 48 hours’ direct notice. Less notice means the Lesson is forfeited and paid in full. 5.2 Changing Instructor is only permitted for material issues (e.g., repeated no-shows, unsafe vehicle), judged at our discretion. We will endeavour to reallocate without extra fee. 5.3 Non-material issues (e.g., personality clash, minor lateness) do not entitle you to change Instructor or refund.
6. Test Bookings 6.1 Where included, we use reasonable endeavours to book tests matching your preferences within advertised timescales. Availability depends on DVSA and is not guaranteed. 6.2 You must notify us promptly of unsuitable dates. Rejecting multiple dates may delay your Course and affect any guarantees. 6.3 Changing/cancelling tests requires sufficient DVSA notice (currently 3-10 working days depending on test type) or you pay rescheduling fees. 6.4 The Instructor may refuse vehicle use for a test if they deem your standard unsafe. 6.5 We are not liable for DVSA cancellations/rescheduling.
7. Payments and Fees 7.1 Course fees (“Fees”) include our admin fee, Instructor tuition, and DVSA test fees (one practical standard). 7.2 An initial payment is required at booking; balance due upon Instructor allocation unless paid in full upfront. 7.3 Payments are held and forwarded to the Instructor/DVSA on your behalf. Do not pay Instructors directly – this breaches our terms. 7.4 Late payment may place your Course on hold, cancelling tests if prolonged.
8. Money-Back Guarantee (where advertised) 8.1 Applies only if we fail to allocate a Suitable Instructor or secure a suitable test within stated timescales, and certain conditions (e.g., reasonable availability) are met. 8.2 Rejecting tests or restricted availability voids the guarantee.
9. Cancellations and Refunds 9.1 You may cancel within 14 days (cooling-off) if no services started, but waive this by requesting immediate allocation/booking. 9.2 Post-allocation, fees are generally non-refundable except for unused hours in specific cases (e.g., material Instructor issue). Admin fees retained. 9.3 Refunds processed to original payment method within 10 working days.
10. On Hold and Expired Courses 10.1 We may place your Course on hold for non-response, non-payment, or your request. 10.2 Prolonged hold (>90 days) may cancel the Course with fees non-refundable.
11. Liability 11.1 We are not liable for losses due to events outside our control, your actions, or Instructor issues. 11.2 Our liability is limited to foreseeable losses from our breach.
12. Personal Data 12.1 We process your data per our Privacy Policy for Course management, test bookings, and marketing (with consent). 12.2 You consent to us accessing DVSA systems on your behalf for test bookings.
13. Complaints 13.1 Email contact@wizdriving.co.uk. We aim to resolve within 10 working days.
14. General 14.1 These terms are governed by English law. 14.2 We may amend terms; continued use implies acceptance. 14.3 Zero tolerance for abuse towards staff/Instructors.
